What is the EB-4 visa?

The EB-4 visa is a special permanent residence category for certain groups of workers who do not qualify under traditional categories. The most common include:

  • Religious workers (pastors, priests, nuns, missionaries, etc.)
  • Former U.S. government employees abroad
  • Afghan/Iraqi interpreters who worked with the U.S. military
  • Members of international NGOs and other special categories

Eligibility Requirements (Religious)

✔️ Have worked for at least two years in a recognized religious organization outside or inside the U.S.

✔️ Continue working in the U.S. in a ministerial position (pastors, preachers) or professional religious position (religious teachers, consecrated brothers).

✔️ The organization must be a religious nonprofit entity registered as a 501(c)(3) with the IRS.

What is the EB-4 visa process?

  • Form I-360: Filed by the religious employer (or the employee if they qualify for a self-petition).
  • Approval by USCIS.
  • Visa assignment if space is available.
  • Adjustment of status (if already in the US) or consular processing (from abroad).

📄What documents are required?

  • Completed Form I-360.
  • Evidence of previous and current employment with the religious organization.
  • Organization tax documents (proof of tax exemption).
  • Certificates of ordination, membership, or training.
  • Evidence of financial ability to sustain employment.

Restrictions

⚠️ Once a Green Card is obtained, there is no obligation to continue working for that organization, although good faith is expected.

⚠️ This visa cannot be used for administrative or support positions (secretary, accountant, etc.).

Can I bring derivative relatives?

A spouse and children under 21 can apply for residency as dependents.
